Effective 21 October 2026 · App Strategist LLC, Virginia, USA
These terms are an agreement between you and App Strategist LLC, a Virginia limited liability company, covering BipolarOS (“bpOS”) — the web app, the native app, and the Loop. Using bpOS means you accept them. There is no arbitration clause and no class-action waiver in here; if we ever have a dispute, it goes to a Virginia court like anything else.
bpOS is for adults. By using it you confirm you are at least 18.
bpOS is not a medical device, and it is not a clinical, diagnostic, or crisis-intervention tool. It does not diagnose. It does not predict episodes. It does not treat anything. It is not a substitute for professional care, and nothing in it is medical advice. It is a self-directed instrument you operate alongside whatever care you choose.
If you are in crisis in the US, call or text 988. If you are in immediate danger, call your local emergency number.
The crisis screen is a router to real services — bundled crisis lines and the emergency contacts you entered yourself. We do not operate those services, employ their counsellors, or have any part in what happens on those calls. We include the numbers and keep them working offline; everything beyond that is between you and them. We make no promise that any third-party line will answer, or answer well.
Patterns and observations the app surfaces are descriptions of your own past entries, offered for you to interpret. They are never a verdict and never a forecast, and the app stays silent when your data is thin rather than guessing.
Everything you write in bpOS is yours. We claim no ownership of it and no licence to use it for anything beyond operating the features you turn on — delivering a Loop message you asked us to send, or storing a backup you asked us to store. We do not read it for product research, we do not train anything on it, and we do not sell it. What reaches us at all is enumerated in the Privacy Policy, and for most users the answer is nothing.
Export produces a plain file on your device, any time, by your own action.
If you invite someone into your loop, you are responsible for that choice and for what you write about them. The “how to show up” note you write is readable by us and is shown to that person, because it is rendered to someone who holds no key — the Privacy Policy explains why. Write it accordingly.
The app is free — all of it. No trial, no tiers, nothing withheld, no ads, and no upsell inside a crisis path.
bpOS is built by The Bipolarist, where a subscription is $5 a month or $50 a year. That subscription buys the writing, and it covers the one part of bpOS that costs money every time it is used: text messages — check-in texts to your loop, and your own daily reminder. Your loop works either way; without a subscription it works by email. The line is drawn at cost, not at capability.
Subscriptions are sold, billed, and cancelled through Substack under Substack’s terms. We never see your payment details. Cancelling ends the text-message capability and nothing else; the app keeps working and your record is untouched.
If you enable encrypted backup when it ships, you will set a passphrase and generate a recovery key. Neither is stored anywhere we can reach. There is no escrow, no reset, and no support path: if you lose both, the backup cannot be recovered by us or by anyone else. That is the point of the design, and it is the cost of it.
Your device holds the record, so losing the passphrase loses the backup and not your journal. And losing it never strands your data with us — you can still sign in by email or text and delete everything.
bpOS is offered as it is. We do not promise uptime, and we may change, suspend or discontinue any part of it — including the Loop and the server side entirely. Because the device holds the record, the app keeps working on your own device if our servers go away; features that depend on us, obviously, do not. If we ever shut the service down we will give notice in the app and leave export working.
Do not attempt to break into other people’s accounts or data, interfere with the service, send unsolicited messages through it, scrape it, or use it to harm anyone. We may suspend or terminate access that does any of those.
TO THE FULLEST EXTENT PERMITTED BY VIRGINIA LAW, bpOS IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT bpOS WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MESSAGE, REMINDER, OR CRISIS NUMBER WILL BE DELIVERED OR WILL FUNCTION WHEN YOU NEED IT.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, APP STRATEGIST LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR LOSS OF GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF bpOS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO bpOS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS.
Nothing in these terms limits liability that cannot be limited by law.
These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Virginia, and both of us consent to that jurisdiction. Nothing here waives any right you have under a consumer protection or consumer health data statute of your own state, including any private right of action it gives you.
We may update these terms. If a change materially affects your rights we will say so in the app before it takes effect. You can stop using bpOS at any time, and delete your data and account from inside it.
